एकल पट्टा भ्रष्टाचार मामले में भजनलाल सरकार का बड़ा कदम

सरकार की नई अर्जी में क्या है?
एकल पट्टा भ्रष्टाचार मामले में भजनलाल सरकार ने राजस्थान हाई कोर्ट का रुख करते हुए याचिका दायर किया है, जिसमें नई जांच की मांग के साथ पुनरीक्षण याचिका वापल ली है । वहीं ट्रायल कोर्ट के फैसले को स्वीकार किया जिसमें अभियोजन को वापस लेने की अनुमति देने से इनकार कर दिया गया था । अब सरकार ने दोषपूर्ण क्लोजर रिपोर्ट को चुनौती देते हुए निष्पक्ष जांच की मांग की है ।
क्यों उठाए गए नए कानूनी कदम ?
राज्य सरकार के अतिरिक्त महाधिवक्ता (AAG) शिव मंगल शर्मा और विशेष लोक अभियोजक (SPP) अनुराग शर्मा ने इस याचिका को अंतिम रूप दिया है। याचिका में यह दावा किया गया है कि पूर्व में दायर क्लोजर रिपोर्ट अधूरी थी और जांच में गंभीर चूक हुई थी। न्यायमूर्ति (सेवानिवृत्त) आरएस राठौड़ की अध्यक्षता में गठित एक उच्च स्तरीय समिति ने इस मामले की समीक्षा कर कई गंभीर खामियों को उजागर किया था। रिपोर्ट में कहा गया कि महत्वपूर्ण दस्तावेजों और ठोस सबूतों की अनदेखी की गई थी, जिससे क्लोजर रिपोर्ट संदेह के घेरे में आ गई।
सरकार ने पुनरीक्षण याचिका वापस क्यों ली ?
राजस्थान सरकार ने पुनरीक्षण याचिका वापस लेकर ट्रायल कोर्ट के फैसले को समर्थन दिया है। ट्रायल कोर्ट ने पहले मामले को बंद करने से इनकार कर दिया था, जिसे अब सरकार ने सही माना है।
हाई कोर्ट में होगी बड़ी बहस
भारत के सॉलिसिटर जनरल (SG) तुषार मेहता, अतिरिक्त सॉलिसिटर जनरल (ASG) एस.वी. राजू और AAG शिव मंगल शर्मा ने इस मामले की गहन समीक्षा की है। ये सभी वरिष्ठ विधि विशेषज्ञ 10 फरवरी को राजस्थान हाई कोर्ट में इस पर बहस करेंगे।
क्या है एकल पट्टा प्रकरण ?
दरअसल, 29 जून 2011 को जयपुर विकास प्राधिकरण ने गणपति कंस्ट्रक्शन के मालिक शैलेन्द्र गर्ग के नाम पट्टा जारी किया था । इस मामले को लेकर आरोप लगाया गया कि इसमें बड़े पैमाने पर भ्रष्टाचार हुआ है । पुराने रिजेक्शन की जानकारी जुटाए बिना नया पट्टा जारी किया गया है । परिवादी रामशरण सिंह ने 2013 में इसकी शिकायत एसीबी से की थी । मामला बढ़ा तो तत्कालीन गहलोत सरकार ने पट्टा रद्द कर दिया था ।
इस मामले में तत्कालीन ACS जीएस संधू समेत 6 आरोपियों की गिरफ्तारी हुई थी । एसीबी ने इस मामले में शांति धारीवाल से भी पूछताछ की थी । बाद में इस मामले में परिवादी ने शांति धारीवाल को भी आरोपी बनाने का प्रार्थना पत्र लगाया था । इसके खिलाफ शांति धारीवाल ने हाईकोर्ट में अपील की थी । तब सुनवाई करते हुए हाईकोर्ट ने धारीवाल को राहत देते हुए एसीबी कोर्ट में चल रही प्रोटेस्ट पिटिशन और अन्य आपराधिक कार्रवाई को रद्द करने के आदेश दिए थे ।
हालांकि सरकार की इस नई पहल से यह स्पष्ट हो गया है कि भजनलाल सरकार भ्रष्टाचार के मामलों की निष्पक्ष जांच सुनिश्चित करने के लिए सख्त कदम उठा रही है। अब इस मामले की अगली सुनवाई हाई कोर्ट में होगी, जहां सरकार अपने दावों को मजबूत करने का प्रयास करेगी।
