राजस्थान: कंवरलाल मीणा की विधायकी खतरे में, विस अध्यक्ष करेंगे फैसला
राजस्थान में 2001 से 2025 के बीच ऐसे कई मामले सामने आए, जिनमें विधायक या मंत्री गंभीर आपराधिक मामलों में आरोपित हुए। इनमें से कुछ को दोषी पाया गया और उनकी सदस्यता समाप्त कर दी गई। वहीं कई मामले ऐसे भी थे, जिनमें विधायकों पर गंभीर आरोप लगे, लेकिन बाद बाद में अदालत से बरी हो गए।
अंता विधानसभा क्षेत्र से एमएलए कंवरलाल मीणा की विधायकी अब संकट में है। बारां की एक अदालत द्वारा उन्हें दो साल की सजा सुनाए जाने के बाद उनकी विधानसभा सदस्यता समाप्त हो सकती है। उनकी सदस्यता पर फैसला विधानसभा अध्यक्ष वासुदेव देवनानी के हाथों में है। जानकारों की मानें तो सदन के किसी भी सदस्य के दोषी पाए जाने के बाद विधानसभा अध्यक्ष अपने विशेषाधिकार का उपयोग कर विधायक की सदस्यता खत्म कर सकते हैं। लिली थॉमस केस के बाद यह साफ हो गया है कि अदालत से दोषी होने पर कोई जनप्रतिनिधि सदन में नहीं रह सकता।

2013 में ‘लिली थॉमस बनाम भारत संघ’ मामले में सुप्रीम कोर्ट ने फैसला सुनाया कि यदि किसी जनप्रतिनिधि को दो वर्ष या उससे अधिक की सजा होती है, तो वह स्वत: अयोग्य हो जाएगा। इससे पहले दोषसिद्ध जनप्रतिनिधियों को अपील के लिए तीन महीने का समय मिलता था और वे तब तक पद पर बने रह सकते थे।
कई विधायक खतरे की जद में
2024 तक राजस्थान विधानसभा में 40 से अधिक विधायकों पर आपराधिक मामले दर्ज हैं। इनमें से कुछ मामलों में चार्जशीट दाखिल हो चुकी है और कुछ की सुनवाई जारी है। जैसे-जैसे अदालतें तेजी से कार्य कर रही हैं, आने वाले समय में और भी विधायकों की सदस्यता पर खतरा मंडरा सकता है।

बीएल कुशवाह (2016): ये था पहला मामला
2013 में बीएसपी के टिकट पर धौलपुर से विधायक चुने गए बीएल कुशवाह को 2016 में एक छात्र नेता की हत्या के मामले में आजीवन कारावास की सजा सुनाई गई थी। इसके बाद उनकी विधायकी समाप्त हो गई थी। बाद में उनकी पत्नी शोभा रानी कुशवाह ने 2017 के उपचुनाव में भाजपा के टिकट पर जीत हासिल की थी।
कुछ अन्य चर्चित मामले
महिपाल मदेरणा (2011): राजस्थान के कद्दावर नेता महिपाल मदेरणा का नाम 2011 में भंवरी देवी अपहरण और हत्या कांड में सामने आया। सीबीआई जांच में दोषी पाए गए और उन्हें मंत्री पद से इस्तीफा देना पड़ा। कांग्रेस ने उन्हें निष्कासित कर दिया। लगभग 9 साल जेल में बिताने के बाद 2021 में उन्हें जमानत मिली। विधायकी समाप्त नहीं हुई क्योंकि सजा नहीं हुई थी।
मलखान सिंह विश्नोई: लूणी से विधायक मलखान सिंह विश्नोई पर भी भंवरी देवी केस में आरोप लगे। उन्होंने लगभग 10 साल जेल में बिताए। दोषसिद्ध नहीं हुए, लेकिन राजनीतिक करियर प्रभावित हुआ।
बाबूलाल नागर (2013): दूदू से निर्दलीय विधायक बाबूलाल नागर पर बलात्कार का आरोप लगा, मंत्री पद से इस्तीफा देना पड़ा, गिरफ्तार हुए। बाद में सभी आरोपों से बरी हो गए।
अमृत लाल मीणा (2021): फर्जी मार्कशीट मामले में गिरफ्तार हुए, बाद में जमानत मिली। 2024 में उनका निधन हो गया।
